Data processing

Personal data is collected and used to assist in the preparation of family trees to identify heirs to estates and to establish the ownership of unclaimed assets and property along with other estate administration tasks.

 

What information we collect about you and how we obtain it

Details of the Client's name, address and date of birth may be submitted to a reference agency, and personal data will be processed by and on behalf of Grafton in connection with the Services we provide.
 

Sources of information

• Third party databases (payable service). Ancestry.com and genealogy information services
• Land Registry search
• Information provided by a statutory authority or regulator such as Council
• In a publicly accessible source e.g. a website, on social media or in a media publication
• Asset reunification database service provided by LexisNexis Information Services which utilises many sources of information including Voters Roll and ‘opted in’ marketing lists.


Our reasons for processing your personal information

• To comply with a legal obligation;
• To perform a contract with you or to take steps at your request before entering into a contract with you;
• When it is in our legitimate interests or those of another third party, providing that these interests are not overridden by your own interests and rights.


How we use your information for legitimate purposes

Grafton processes personal information about you where we or a local authority has a legitimate interest to do so. The purposes include:
• You are the proprietor/co-proprietor of a property that is vacant
• You are a relative or a next of kin of the proprietor/co-proprietor of a property that is vacant
• You are an executor of a deceased estate
• You are a beneficiary of an estate/deceased estate.


Sensitive Personal Information

Under the General Data Protection Regulation "sensitive personal data" means information about such matters as health, religious beliefs, political opinions, race or ethnicity, sexual orientation and criminal convictions. We do not usually need to process any data in this category but if the need arose it would not be done without your explicit consent.


Data Disclosure

Grafton may need to share limited personal information with the following organisations:

  • Statutory/regulatory authorities such as councils
  • Professional and legal advisors.
     

Personal information may be shared with our clients (e.g. a solicitor, estate administrator, local authorities) for the purposes of their legal duties and obtained from open data sources and/or third parties for the purposes of providing our services to clients (eg, asset reunification subscription services, family history websites).

Grafton will not disclose any personal information about you to any third parties without obtaining your consent.

If we intend to transfer your information outside the EEA (European Economic Area) we will always obtain your consent first.
